It will go to an arbiter. Listen, he sought outside medical treatment and then rehabbed away from the team. He was not given permission for either. When you are on a big contract like this one, you jump when they tell you to jump. These contracts are typically iron clad in terms of your responsibilities, but usually arbiters side with the employee over the employer. This is the Yanks' attempt to get out from under the financial obligation. I do not think they will be successful, but it is at least a reasonable argument.

 

It might not be reasonable, depending on the language of the CBA and what, if anything, Ellsbury did. He might have actually complied to the letter of the CBA.

 

What probably hurts the Yankees the most here is the timing. They’re suddenly upset about his rehab on his release date? How long ago did they learn? If you knew some story about him going AWOL and rehabbing off site away from the team, how long ago did you learn that? It’s a very safe bet the Yankees knew anything long before you did. So why wasn’t this brought up then?

 

It almost feels like a case of “we’re cutting him anyway. Let’s see what salary we can recoup.”

To be fair, Ellsbury didn't actually "play" for the Yankees. Just collected paychecks ;)

What exactly is the injury that prevented him from playing?

No one knows. They stopped giving injury updates on him a long time ago, because they ran out of things to say. It became obvious to me, that the Yankees had moved on from him and were just looking for a way to sever the relationship.

In light of the Yankees' reported attempt to recoup, could the insurer cite the same reasons in an attempt to recoup its payments to the Yankees?

 

It's probably all in the details of the insurance policy, the Ellsbury contract and the Collective Bargaining Agreement.

Well, here is the deal with the insurance. The player needs to miss the entire campaign for most policies, a considerable amount for others. Ellsbury says he will be playing in 2020, so hanging onto him for insurance reasons wasn't gonna happen. So the insurance issue is out the window if he is cleared to play

Neither the union (nor the league office) is ever going to allow teams to use the tactic of acquiring players for inflated salaries, then refusing to pay those (guaranteed) salaries if the player doesn't produce accordingly.

Pick a joint and he had an issue with it

 

It’s a shame. Some guys just get hurt easy and everywhere. Stops some of the greats from being great. Hate seeing injuries get the best of players.

Yankees will pay. They didn't want him the last two years. They would not have played him even if he was healthy. They didn't care where he rehabbed. What a bunch of liars.

i said it pages ago...this is a bush league move. george is turning over in his grave. at least when he was alive and bought championships he paid his players. yankees have become a laughing stock organization. their owners are a joke. whats next? a bus for away games a la Major Leagues? yankees have become a joke.

Big deal. He hated the Ellsbury signing.

 

I hated the Sandoval signing from the moment it became a rumor, but I never once said the Sox should stop paying him. and unlike Ellsbury, I don't think Sandoval was rehabbing or doinganything physical at all, approved or not...
