I think its a judgment call by the ump, and I guess he didn't think it was intentional.

They did give warnings. Remy claimed it was the reason that Lugo was called out on that slide into second.

Yeah, but the call is automatic...same as overlooking a guy sliding into second who can't reach the bag (and, TheKilo, I insist that Lugo could have reached the bag with his left hand entering the slide).
